Unpaid Overtime

We vigorously represent employees who have worked more than 40 hours in a workweek and have not been paid the legally required overtime rate (typically 1.5 times their regular rate of pay). This includes situations where employers:

  • Fail to accurately track and record all hours worked.

  • Miscalculate overtime pay.

  • Improperly classify employees as exempt from overtime requirements.

  • Pressure or force employees to work off the clock.

Minimum Wage Violations

We fight to ensure that all employees are paid at least the applicable federal, state, and local minimum wage. This includes addressing situations where employers:

  • Pay less than the legally mandated minimum wage.

  • Make illegal deductions that bring an employee's pay below minimum wage.


Employee Misclassification

Employers sometimes misclassify employees as independent contractors to avoid paying overtime, minimum wage, and providing benefits. We help determine the proper classification of your employment and pursue claims on your behalf if you have been misclassified. This includes analyzing factors such as:

  • The degree of control the employer has over the work performed.

  • The worker's opportunity for profit or loss.

  • The permanency of the working relationship.

  • The extent to which the worker's services are an integral part of the employer's business.
